For Strudell Studios Store Customers Only
When you purchase goods through Strudell Studios Store, you are granting Strudell Studios express permission to share your name and contact information (as well as the “ship to” name and contact information, if different) with the merchant from which you make the purchase, for the purposes of shipping and order fulfillment only. By making a purchase from a merchant, you are not granting that merchant consent to use your information for marketing or any other purposes unless you specifically “opt in” to do so. Sending Emails
Strudell Studios uses email to communicate with you, to confirm your placed orders, and to send information that you have requested. We also provide email links to allow you to contact us directly. We strive to promptly reply to your messages.

However, you should know that deactivation of your account does not mean your personally identifiable information has been deleted from our database entirely. We will retain and use your personally identifiable information if necessary in order to comply with our legal obligations, resolve disputes, or enforce our agreements.
TERMS OF USE
Availability of Services
Subject to the terms and conditions of this Privacy Policy and Terms of Use, Strudell Studios shall use reasonable efforts to provide hosting services on a twenty-four (24) hours a day, seven (7) days a week basis. You agree that from time to time the hosting service may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs that Strudell Studios may undertake from time to time; or (iii) causes beyond the control of Strudell Studios that are not reasonably foreseeable by Strudell Studios, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures. You further agree that the availability of your hosting service may be inaccessible during periods of time for which you have scheduled upgrades or downgrades to your server.
Server Content
You shall be solely responsible for providing, updating, uploading and maintaining your server content and any and all files, pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your server, including, without limitation: trade or service marks, images, photographs, illustrations, graphics, audio files, video files, email or other messages, meta tags, domain names, software, and text.
You represent and warrant to Strudell Studios that: your content does not and shall not contain any content, materials, data, work, trade or service mark, trade name, link, advertising or services that actually or potentially violate any applicable law or regulation or infringe or misappropriate any proprietary, intellectual property, contract or tort right of any person and that you own your server content and all proprietary or intellectual property rights therein, or have express written authorization from the owner to copy, use and display the content on and within your server account. If your web site includes images or photographs, you must ensure that your images or photographs are properly licensed. You also represent and warrant that the server content being hosted by Strudell Studios shall not be used in connection with any illegal activity.
Abuse of Traffic or Storage
You are responsible for ensuring that there is no excessive overloading of Strudell Studios’ system or servers. In the event that you exceed your allotted bandwidth and thereby overload Strudell Studios’ DNS or servers, you shall be assessed any and all fees, costs and penalties associated with such overloading. You may not use Strudell Studios’ servers and your Server Account as a source, intermediary, reply to address, or destination address for mail bombs, Internet packet flooding, packet corruption, denial of service, or other abusive activities. Server hacking or other perpetration of security breaches is prohibited and Strudell Studios reserves the right to terminate websites that contain information about hacking or links to such information. Use of your server account as an anonymous gateway is prohibited, as is the use of your hosting service to restrict or inhibit any other user from using and enjoying the Internet.
Spamming or Unauthorized Access
You agree not to engage in unacceptable use of any hosting services, which includes, without limitation, use of the hosting services to: (i) disseminate or transmit unsolicited messages, chain letters or unsolicited commercial email; (ii) disseminate or transmit any material that, to a reasonable person may be abusive, obscene, pornographic, defamatory, harassing, grossly offensive, vulgar, threatening or malicious; (iii) disseminate or transmit files, graphics, software or other material, data or work that actually or potentially infringes the copyright, trademark, patent, trade secret or other intellectual property right of any person; (iv) create a false identity or to otherwise attempt to mislead any person as to the identity, source or origin of any communication; (v) export, re-export or permit downloading of any message or content in violation of any export or import law, regulation or restriction of the United States and its agencies or authorities, or without all required approvals, licenses and/or exemptions; (vi) interfere, disrupt or attempt to gain unauthorized access to any computer system, server, network or account for which you do not have authorization to access or at a level exceeding your authorization; (vii) disseminate or transmit any virus, trojan horse or other malicious, harmful or disabling data, work, code or program; (viii) engage in any other activity deemed by Strudell Studios to be in conflict with the spirit or intent of this Privacy Policy and Terms of Use; or (ix) use your server as an "open relay" or similar purposes.
Payment and Fees
Strudell Studios reserves the right to suspend websites and domains from viewing on the Internet when payments are five standard days past payment. Email payment reminders are sent to the primary account holder listed in the Strudell Studios Online Client Portal. In case collection proves necessary, the Client agrees to pay all fees incurred by that process. For unforeseen server or network outages not caused by customer actions, Strudell Studios offers a prorated money back guarantee for services. All payments are made in US funds.
Server Backups
The backup process for Strudell Studios servers is performed through tape backup and stored to an internal server into a compressed format. Full backups are performed weekly and incremental backups performed daily. Backups are maintained for a 4-week cycle, and then the data is formatted and overwritten. Strudell Studios guarantees a 1-day backup copy to customers.
Disputes
In the event that any legal action is brought against Courtland Consulting, Courtland will require the client to compensate Courtland for all Legal Fees including but not limited to Attorney Fees, Legal Fees and any business time lost if Courtland is absolved of any wrong doing.
CHANGES IN OUR PRACTICES
Strudell Studios reserves the right to modify this Privacy Policy and Terms of Use at any time. If we decide to change our Privacy Policy, we will post those changes to this privacy statement, our announcements page, and other places we deem appropriate, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
